Trademarks & Trade Names
Nordson vigorously protects its trademarks and trade names around the world. To assure uniformity and proper use worldwide, it is important to understand the difference between trademarks and trade names and the rules associated with their use.
Trademark and Trade Name Use Guidelines
A trademark is a word, symbol, letter, number or a combination thereof used on or in association with a product to distinguish the product from similar products in the marketplace. The use of a trademark on a product creates goodwill for its owner and assures a potential purchaser that the trademarked product originates from the same entity as other products bearing the same trademark.
A trade name is a word, symbol, letter, number or a combination thereof used to identify a business or organization.
1. Trademarks
Nordson separates all of its trademarks into three groups, namely Corporate Trademarks, Primary Trademarks and Product Trademarks.
- A Corporate Trademark is a trademark used by particular business groups within Nordson.
- A Primary Trademark is a trademark used by a business group on all of its products.
- A Product Trademark is a trademark used by one or more business groups on a single product or product line or across different product lines.
Nordson's Corporate Trademark is as follows:
The Corporate Trademark is referred to as the "Nordson and Arc Design" trademark. As a Corporate Trademark, this mark is used on all goods that are offered for sale by all business groups in all countries where Nordson does business.
The Corporate Trademark is used alone for selected goods and services. For other goods, it is used in a stacked combination with the existing Primary Trademarks as illustrated below:
Using ® or ™ with Trademarks
The statutory symbol, ®, signifies that a trademark is registered at the United States Patent and Trademark Office. The common law symbol, ™, signifies the user's belief that the associated word, symbol, etc. is functioning as a trademark but it is unregistered. The use of the ® and ™ symbols are optional.
The Corporate Trademarks Nordson and , and the Primary Trademarks are also used as trade names. The statutory symbol ® and the common law symbol ™ are not used with trade names. In order to avoid confusion between trademark and trade name use and whether or not ® or ™ should be used, Nordson is adopting a new policy, namely, ® or ™ will not be used with any Corporate Trademark or Primary Trademark.
Although the symbols ® and ™ will not be used with Corporate Trademarks and Primary Trademarks, those trademarks will be identified as trademarks of Nordson Corporation through the use of a tag line (e.g. "Nordson, and EFD are trademarks of Nordson Corporation") on certain labels used on Nordson product containers, boxes and crates (see the Law Department for details on these labels).
In addition, Nordson currently uses ® or ™ in association with Product Trademarks. Accordingly, when such trademarks are registered, the ™ must be replaced with ®. Costs are incurred in making these changes. In order to eliminate these costs, Nordson is adopting another new policy, namely, ® or ™ will not be used with any Product Trademark used on an actual product or packaging, however, ® or ™ will be used with Product Trademarks when those Product Trademarks are used in print or electronic media.
2. Trade Names
Nordson uses as a new trade name for use in signage, stationary, advertising, PowerPoint, web sites and the like. In addition, the trade name
is being used in a stacked combination with the existing trade names as illustrated below:
For use in print media, Nordson is also utilizes the following new trade names:
- Nordson EFD
- Nordson ELECTRONICS SOLUTIONS
- Nordson MEDICAL
- Nordson SEALANT EQUIPMENT
- Nordson TEST & INSPECTION
3. Trademark and Trade Name Use
The following table provides some examples of correct and incorrect usage of Nordson's trademarks and trade names.

As illustrated above, for Product Trademarks, the ® symbol should be used in print or electronic media if the trademark has been registered. In the case where the Product Trademark has not been registered, the ™ symbol should be used in print media.
All trademarks, whenever possible, should be used in the exact form adopted by Nordson. The proper form for all of Nordson's trademarks is found here at the Law Department's site on the intranet.
Other general usage guidelines include:
- Product Trademarks should always be used as an adjective followed by a noun, which describes the generic product or service (i.e., SureFoam™ dispensing system, Encore® manual powder spray system).
- Trademarks should never be used in a possessive form. Do not use "Encore's® manual spray gun..." Instead, use "The Encore® manual spray gun..." It is permissible however, to use the trade names in a possessive form.
- Never pluralize a trademark (i.e., "...several Encores® can be used..."). Plural usage of a trademark suggests the use of the word as a noun not an adjective. Instead, pluralize the noun following the adjective (i.e., "...several Encore® powder spray systems can be used...").
- When introducing a new product, the decision of whether or not a Product Trademark should be used is made by the business group involved. Remember the new product will be associated with a Corporate Trademark and/or a Primary Trademark which are already familiar to the customer. Accordingly, a Product Trademark should only be used if, in the judgment of the business group involved, it will either (a) assist Nordson in selling the new product by distinguishing the new product in the marketplace, or (b) make the new product easier for the customer to recognize or purchase.
4. Use of Nordson Trademarks by Others
In addition to Nordson properly using and identifying its trademarks and trade names, it is important that others, including distributors, agents and representatives, do the same. Only someone that has received permission can use statements such as "authorized distributor for ... " or "Representing ...". If you see the improper use of one of Nordson's trademarks or trade names or encounter someone incorrectly representing themselves as a distributor or representative, promptly contact the Nordson Law Department.
5. Administration
The Intellectual Property section of the Law Department is responsible for clearing new trademarks and trade names, monitoring the proper use of trademarks and trade names and registering and maintaining trademarks.
